Preamble

In these Terms and Conditions, "Consumer", "Traveler", "You" and "Yours" means you the person who purchases travel plans or any person you agree to allow to purchase travel plans on your behalf. The person making the booking must be at least 18 years old and must be authorized to make bookings on behalf of the members of the traveling party."Ultitude" and the "Company" mean Cadmus LLC d/b/a Ultitude and its agents. Please read these Terms and Conditions carefully. They apply to all bookings made through the Company and govern your relationship with the Company.Please review your booking confirmation, invoice and travel documents carefully as soon as you receive them. Immediately notify the Company or your booking agent with any discrepancies or questions.Proof of Identity is required for all travel. Without proper identification, which means both a valid passport and appropriate visas the traveler will be denied departure. It is your responsibility to obtain the proper travel documents.

Deposit and Final Payment

A deposit of $750 per person is required at time of booking. This deposit is non-refundable.The deposit forms part of your final payment which in no circumstances is due later 60 days prior to departure. If the Company does not receive final payment by the specified date, we reserve the right to cancel the reservation. In the case of billing errors, we reserve the right to re-invoice with correct pricing. Charge card payments require certain information.

Revision Fee

A handling fee of $75 per transaction will be charged for any alterations or revisions. Spelling corrections to clients' names after air tickets have been issued are subject to airline revision fees. A change of date or itinerary within 45 days of departure will be treated as a cancellation and new booking; regular cancellation fees apply.

Cancellations and Cancellation Fees

Cancellations are very costly and usually do not occur in time for resale of the particular program element. This is particularly true with the Company's programs since many of the properties used have as few as ten rooms so the loss of one room's occupancy is disproportionately higher than a large hotel. If cancellation in writing is received by the Company more than 45 days prior to departure, the non-refundable deposit will be retained and the balance returned to the traveler. For cancellations received within 45 days of departure, the following per person cancellation fees apply:

  • 44-30 days prior to departure: 25% of the remaining balance
  • 29-15 days prior to departure: 50% of the remaining balance
  • 14-7 days(s) prior to departure: 75% of the remaining balance
  • 6 Days or less prior to departure 100% of the remaining balance

 

We strongly recommend Travel Insurance as a means of covering or mitigating cancellation penalties due to illness or other approved reasons. We offer Travel Insurance through an independent company but you are free to purchase insurance elsewhere. There are different types of medical, baggage and trip cancellation insurance available from suppliers and independent agencies. Please note: Many medical insurances do not cover pre-existing conditions and may have other restrictions and exclusions. Consult the insurance carrier for details. Insurance premiums are non refundable as cancellation coverage begins immediately after purchase.

Special Needs

While the Company will make every attempt to accommodate persons with special needs if they have disclosed those needs to the Company or the booking agent, it is ultimately dependent on the availability of the supplier and the destination selected. Not all countries have the same availability or laws concerning special needs.

Disputes

While Ultitude makes every attempt to insure that every aspect of your travel experience is pleasant, in the event that you experience difficulty or are unhappy with any service, you must advise the local supplier and Ultitude immediately at the time the difficulty occurs. The company will attempt to resolve any issue immediately. If you are still dissatisfied, you must contact Ultitude in writing within 28 days of your return. Failure to lodge a complaint and advise the supplier at destination may render the dispute irresolvable.

Pre Departure Information

Travel Documents will be sent 30 days before departure provided that full payment has been received. Since the Company operates on all continents, information regarding baggage allowance, laundry service, gratuities to drivers etc. varies by destination. Your travel documents will contain information specific to your area and/or program.

Disclaimer of Liability

Cadmus LLC, d/b/a Ultitude is acting as a mere agent for suppliers in selling travel related services such as air and ground transportation, hotel accommodations, meals sightseeing tours etc. The Company shall not be responsible for breach of contract or any intentional or careless actions or omissions on the part of such suppliers which may result in loss, damage, delay or injury to you or your travel companion. The Company shall not be responsible for any injuries, damages, or losses caused to any traveler in connection with terrorist activities, social or labor unrest, mechanical or construction failures or difficulties, diseases, local laws, climatic conditions, criminal acts, or abnormal conditions or developments, or any other conditions outside the Company's control. Traveler assumes complete and full responsibility for and hereby releases the Company from any duty of checking or verifying any and all passport, visa, vaccination, or other entry requirements of each destination, and all safety or security conditions at such destinations during the proposed length of travel. By embarking upon your travel, you voluntarily assume all risks involved in such travel, whether expected or unexpected. Traveler is hereby warned of such risks and is advised to obtain appropriate insurance coverage against them. Accepting and retaining of tickets, reservations or bookings after issuance shall constitute consent to the above and an agreement on the Traveler's part to convey the contents hereto to their traveling companion named on the booking.

Governing Law and Jurisdiction

This document will be governed by, and interpreted under and enforced in accordance with the laws of the State of Florida. Venue and jurisdiction of any action or proceeding arising out of or connected with this agreement shall lie exclusively in the state courts of the Ninth Judicial Circuit, in and for Seminole County, Florida, or the United States District Court for the middle District of Florida, or the Division. The parties expressly waive all other jurisdiction or venue.
